    Title 22 Regulation 101430 E states that if an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible.This requirement was not met as evidenced by: LPA observed an infant (C1) whom was sleeping in the arms of a staff member. LPA was informed that the the infant was sleeping in the office in the arms of a staff member as per parent/authorized representative request and the infant's comfort for napping.

    (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement is not met as evidenced by: Pertinent interviews disclosed that a 2-month-old infant was not properly secured in a highchair. It was revealed that the infant in the highchair was too small for the highchair and there was not enough neck support available for the child, due to their size.

It was revealed that that both teachers were aware that the infant was falling asleep on the floor but were both preoccupied with other infants in care.

    Based on record review, the licensee did not comply with the section cited above. C1, C5, and C6 does not have an Infant Sleep Log available for review, which poses a potential health, safety risk to persons in care.
