What the inspector wrote

On the date and time listed above, Licensing Program Analyst (LPA) Chase Atherton, arrived at the facility to conduct a Case Management inspection for the purpose of addressing separate matters that were discovered during an inspection at the facility on 1/26/2026, 1/30/2026, & 2/19/2026. During the above inspection dates LPA made observations, conducted interviews with pertinent parties, and reviewed records. While conducting an inspection on 1/26/2026, 1/30/2026, & 2/19/2026, information gathered stated that there were 3 separate incidents where a child bit another child and the bite broke skin. The biting incidents were documented on “Incident Report Forms” within that dates of 1/14/2026 – 1/20/2026, which were signed by the staff and authorized representatives. This does not comply with Title 22 Personal Rights requirements in that the facility is required to provide a safe and healthful environment for all children. See LIC809D for the deficiencies cited. After these incidents, the facility implemented a change of classroom operations and scheduling in order to reduce the amount of biting, to ensure that all children’s Personal Rights were not being violated. Since the implementation of the classroom operation and schedule change there has been a significant reduction in biting occurrences. LPA Chase Atherton informed Facility Representative Margaret Van Duzer that this report dated 2/19/2026 document(s) 1 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Chase Atherton informed Facility Representative Margaret Van Duzer to provide a copy of this licensing report dated 2/19/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted, and report was reviewed with the facility representative Margaret Van Duzer.

These unusual injuries were not reported to the Department, which poses/posed a potential health, safety, or personal rights risk to persons in care.

    101233 Personal Rights – (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations...This requirement is not met as evidenced by: Based on interview and record review, there were 3 child-to-child biting incidents that broke skin within the dates of 1/14/2026 – 1/20/2026. The facility has since implemented operational changes that have greatly reduced biting incidnetns. This poses/posed an immediate Personal Rights risk to the children in care.
