ARTICLE 2. Administration of Child Day Care Licensing

Based on observation, interview, record review, the licensee did not comply with the section cited above by not completing and providing receipt of a valid mandated reporter certificate and was expired on 1/31/2025, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation and record review, the licensee did not comply with the section cited above in that C1 did not have an Individual Sleeping Plan (LIC 9227) on file which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation and record review, the licensee did not comply with the section cited above in that C1 did not have documentation for infant safe sleep log- 15 min check, which poses/posed a potential health, safety or personal rights risk to persons in care.

Alterations to Existing Buildings or Grounds – “ … The licensee shall provide the Department with a copy of an inspection report when an inspection is required by the local building inspector as a result of the alteration, addition or construction.” This requirement is not met as evidenced by: Based on interviews and records reviewed the Licensee did not provide the Department with a copy of the local building inspection report, which poses as a potential risk to children in care.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above as evidenced by having a certificate that expired in 2020, which poses/posed a potential health, safety or personal rights risk to persons in care.

ALTERATIONS TO EXISTING BUILDING OR GROUNDS

102416.3(a)(6) - Alterations to Existing Buildings or Grounds. Prior to making alterations…to a family child care home…the licensee shall notify the Department… but not limited to, the following:(6)-Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. This requirement was not met as evidenced by: Based on interviews and record review the licensee did not comply with the section cited above, as the licensee allowed C1 to enter the garage, an off-limit area during daycare hours, which poses/posed a potential health and safety risk to persons in care.

STAFFING RATIO AND CAPACITY

Staffing and Ratio Capacity: 102416.5(e)If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c).This requirement was not met as evidenced by:The Larraga, Janelle Family Child Care provided care for more than 8 children on more than one occasion when only one staff member was present in the home. This could pose a threat to children in care.
