PERSONAL RIGHTS

101223 Personal Rights:(a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from… unusual punishment… humiliation, intimidation… or other actions of a punitive nature...interference with medication. This requirement was not met as evidenced by: Based on interviews and pertinent documents, facility declined to follow doctor orders for child’s (C1) rash. This poses a potential health, safety or personal rights risk to children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision -(a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by: Based on interviews and pertinent documents staff did not supervise infant in infant room to ensure injuries were prevented to a child (C2). This poses a potential health, safety or personal rights risk to children in care.

ARTICLE 1. General Provisions and Definitions

Based on record review, the licensee did not comply with the section cited above in one out of four staff files reviewed do not have verification of immunization to measles available for review. This poses a potential health, safety or personal rights risk to persons in care.

ALTERATIONS TO EXISTING BUILDINGS OR NEW FACILITIES

101237(a) Alterations to Existing Buildings or New Facilities: (a) Prior to construction or alterations, the licensee shall notify the Department of the proposed change(s). This requirement was not met as evidenced by: Based on LPA's observation the infant facility/nap area was altered prior to notification and approval by Community Care Licensing. This poses a potential health and safety risk to children in care.

101226.1 Daily Inspection for Illness: (a) The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted. This requirement was not met as evidenced by: Based on a record review, on 4/18/22 five children were allowed to remain at the facility with symptoms of illness. This poses a potential health and safety risk to the children in care.

INFANT CARE FOOD SERVICE

Based on observation, the licensee did not comply with the section cited above in that two children have food in the facility without the current date. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above. Ten children did not have sleep documentation in their files for dates 2/22/22 and 2/23/22. This poses a posed a potential health, safety or personal rights risk to persons in care.

Infant Care Personal Services...When changing an infant's diapers, the following shall apply:...No infant shall be left unattended while on a changing table.This requirement was not met as evidenced by: Based on observation, interview and review of staff statements, although Staff #1 was standing at the changing table,Child #1 was briefly unattended while Staff #1 looked away to find a diaper, allowing for Child #1 to slip off and fall to the floor. This is a potential hazard to children in care should this not be corrected.
