What the inspector wrote

On April 09,2024 at 11:31am Licensing Program Analysts (LPA's) Joaquin Mendez and Gigi Reyes conducted an unannounced Required 1 Year inspection. LPA's met with licensee Janet Anderson and advised the purpose of the inspection. Licensee provided LPA's a tour of the home inside and out. There were (10) children in care with one (1) child being an infant at the time of the inspection. LPA's observed required licensing documents pinned on the walls throughout the home. Fire and earthquake drills are being documented every three (3) months. Last drill was conducted on 03/14/2024. Fire extinguisher 2A10BC on kitchen floor was last serviced 03/08/2024. Fire and carbon monoxide detectors were observed and tested to be functioning at the time of inspection. Licensee stated there was no firearms or ammunition in the home. Children in care have access to one (1) bedroom (1) restroom, kitchen, (2) living rooms, one (1) dining room and back yard. Fireplace inside the living room has screen and covering to prevent access by children. Licensee states fireplace has not been used. In the kitchen the knives and cleaning supplies are being kept in a cabinet above counters and out of reach from children in care. Continued on 809C Children have access to toys that are age-appropriate inside and outside of the home. Back yard play area is fenced and LPA's did observe a jacuzzi which was properly covered locked and inaccessible from children in care. During the tour, LPA's did not observe any hazards/toxins items accessible to children in care. LPA's reviewed (7) eight children\342\200\231s files. All children files were current however one child's safe sleep plan was missing a filled and signed physicians report and was discussed licensee. Licensee CPR/first aid expires 03/21/2026 and mandated reporter expires 05/22/2025. All assistants have renewed Mandated reporter training which expires 05/30/2025 (A1) is missing immunization records. (A2) was missing MMR records. Licensee was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Continue on 809C Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA's also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA's observed a safe sleep log being documented for infants in care every 15 minutes. Licensee stated there were no children in care that required Incidental Medical Services. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. During the exit interview, the Licensee Janet Anderson, confirmed that there are no Registered Sex Offenders living in the facility and LPA's completed the RSO profile in FAS. During today's inspection appeal rights were given and notice of site visit was issued. Exit interview was conducted and report was reviewed with licensee Janet Anderson.

These rights include, but are not limited to, the following:(2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirment is not met as evidenced by: On 3/27/2024, Child 1 sustained injury and received stiches while riding on a 3 wheel scooter without a helmet, despite the sccoter warning label to wear helmet, knee/elbow pad and wrist guard. This poses a potential risk to health and safety of children in care.
