CRIMINAL RECORD CLEARANCE

101170(e)(2) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 101170(f)This requirement is not met as evidenced by: Based on observation, record review, and interview D1 did not associate 1 of 2 staff present today criminal record clearances to the facility. S2’s criminal record clearances was not transferred to the facility prior to the first day of employment, which poses a potential health and safety risk to persons in care.

REPORTING REQUIREMENTS

101212(d)(1)(E) Upon the occurrence, during the operation of the child care cente...a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours…(1) Events reported shall include the following: (E) Epidemic outbreaks.This requirement was not met as evidenced by: Based on D1 admitting to not reporting the outbreak that began on 04/07/26 and the Department has no record of the incident reported to the Department within the Department’s next working day during normal business hours. This poses a potential health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.The requirement was not met as evidenced by: Based on staff interviews, a child (C1) was allowed to use the bathroom on 12/17/25 by themselves without staff supervision which poses a potential risk to the health, safety, and personal rights of children in care.

CHILD'S MEDICAL ASSESSMENTS

Based on record review, the licensee did not comply with the section cited above in which C1-C5's did not have completed physican reports which poses a potential health safety or personal rights risk to persons in care.

IMMUNIZATIONS

Based on record review, the licensee did not comply with the section cited above in which 2 out of 5 children's records (C1 & C2) did not have immunization records as required which poses/posed a potential health, safety or personal rights risk to persons in care.

Teacher Qualifications and Duties Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2)… (b)(1) A teacher shall have completed, with passing grades, at least six postsecondary semester… or (b)(2) A teacher shall meet the requirements of Health and Safety Code Section 1597.055. This was not met as evidence by... Based on interviews and observations made, On at least two occasions Aides (Staff with 0 early child hood education units) were working in the capacity of a teacher supervising children alone. This poses a potential health and safety risk to children in care.

TEACHER-CHILD RATIO

Teacher-Child Ratio(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. . . This was net met as evidence by... based on interviews on at least one occasion there was one staff left alone supervising more than 12 children this poses a health and safety risk to children in care.

CRIMINAL RECORD CLEARANCE

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 . . .shall prior to working. . .in a licensed facility:(1) Obtain a California clearance . . . this was not met as evidence by. . . Based on guardian search S1 did not have background clearance. This poses an immediate health and/or safety risk to children in care.

101215.1 Child Care Center Directors Qualifications and Duties. If the child care center director is absent for more than 30 consecutive calendar days, the substitute director shall meet the qualifications of a director. This was not met as evidence by. . . based on the interviews conducted and records reviewed there was not person on the site that is a qualified director. This poses a potential health and safety risk to people in care.

REPORTING REQUIREMENTS

101212 Reporting Requirements. Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days . . . Thi was not met as evidence by. . . Based on evidence received and interviews conducted staff did not report an incident resulting in an injury requiring medical treatment. This poses a potential health and safety risk to children in care.

CRIMINAL RECORD CLEARANCE

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 . . .shall prior to working. . .in a licensed facility:(1) Obtain a California clearance . . . this was not met as evidence by. . . Based on roster review, guardian background check search and interviews conducted. S1 and S4 have been present and working at the facility without background clearance. This poses an immediate health and safety risk to children in care.
