What the inspector wrote

On May 28, 2025, Licensing Program Analyst (LPA) Miguel Herrera conducted an unannounced Case Management Inspection. LPA met with Director Heidi Nunes. LPA toured the facility, and a census was taken. The purpose of today's inspection was regarding an Unusual Incident that was self reported by the facility to the Fresno Childcare Regional Office, the incident occurred on 05/20/2025 and 05/21/2025, the incident was regarding a violation of a child\342\200\231s personal rights. During today\342\200\231s visit LPA Herrera conducted facility observations, reviewed records and interviewed staff to gather further information pertinent to the incidents. Through interviews conducted and documentation reviewed, it was confirmed that staff #1 (S1) inappropriately handled child #1 (C1) by pulling on C1\342\200\231s hair and rough handling the child on both occasions. Through interviews and records review, it was determined that the incident was not an isolated incident as S1 had violated C1\342\200\231s personal rights on 05/20/2025 and on 05/21/2025. Through interviews and records reviewed, it was disclosed that the first incident occurred on 05/20/2025 between 9:45am \342\200\223 9:50am, while the classroom was outside playing. Based on interviews and records reviewed it was confirmed that S1 aggressively pulled C1\342\200\231s hair and forcefully pushed C1 towards the classroom. Based on interviews and records review, the second incident occurred on 05/21/2025 at approximately 10am, again, while the classroom was playing outside, S1 pulled C1\342\200\231s hair. Furthermore, LPA Herrera observed still images from the video footage that corroborated both incidents. Although the facility followed appropriate reporting requirements and took appropriate measures to address the incident, S1\342\200\231s actions violated C1\342\200\231s personal rights and posed an immediate risk to children in care (see LIC 809-D Type A deficiency). Continued on 809-C. Exit interview conducted and report was reviewed with Director, Heidi Nunes. Appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see LIC. 809-D). Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Director, Heidi Nunes. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

This requirement was not met based on evidenced of records reviewed, photos and interviews. LPA Herrera obtained corroborating interviews, photos, and documentation that revealed staff #1 rough handled and pulled on child #1’s hair, which posed an immediate risk to the health, safety and/or personal rights to children in care.
