Inspector’s narrative

What the inspector wrote

On 5/16/2024 at 12:30pm, an annual inspection was made to the facility by Licensing Program Analyst (LPA), Elizabeth Friese. Operating hours are 6:00am - 6:00pm, Monday\342\200\223Friday. The facility was toured at 12:30pm inside and outside and the floor and yard plan submitted by the licensee were verified. Facility operates in the smaller of 2 buildings on the property. The facility representative Harinderjit Kaur and another teacher were supervising 6 children, and operating within the licensed capacity and ratio requirements. Licensee Michelle Lightle arrived approximately one hour into inspection. There are no pools or bodies of water on the premises. The outdoor activity space was cushioned with imitation grass and free of hazards. 4 children's records were reviewed at 1:25pm. 2 staff records were reviewed at 2:21pm. The following deficiencies were cited: by record review, one (S2) of 2 staff in infant room did not have required criminal clearance in Guardian, and has been working in the facility since 8/2023. By observation, child (C2) was asleep in a pack and play with a leashed pacifier attached to their clothing. Photo of item taken. (cont) By file review, 1 of 4 (C1) children's files were missing a Physician's Report. By file review, 2 of 4 (C1, C3) children's files were missing 15 minute sleep check logs. A civil penalty of $500.00 was assessed for the criminal clearance citation. (see LIC 809D) LPA Elizabeth Friese informed licensee Michelle Lightle that this report dated 5/16/24 documents 2 Type A citations which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Elizabeth Friese informed the licensee to provide a copy of this licensing report dated 5/16/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensee was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPA referred licensee to the Department website for lead: https://www.cdss.ca.gov/inforesources/child-care-licensing/water-testing-information LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Michelle Lightle.
