What the inspector wrote

On 12/04/2025, Licensing Program Analyst (LPA) Octavia Nolan conducted an unannounced case management incident inspection at the facility. LPA met with Licensee, Holly Oliveira and explained the purpose of the visit. LPA took a tour of the facility and a census. On 11/18/2025, the facility reported an incident to Community Care Licensing (CCL) that took place that morning. At 9:12 AM, Staff #1 (S1) prepared to take a group of children to the playground. Staff #1 opened the door leading to the preschool playground to determine if the children could play outside. A group of approximately seven children were gathered around Staff #1 and the door. Child #1 (C1) put their finger in the opening of the door jamb, while Staff #1 checked the weather. Staff #1 closed the door on the child’s right middle finger, causing a cut on the nail. Staff #1 opened the door to release the child’s finger and did not fully secure the door closed. Staff #1 stated a group of children pushed open the door and went to the playground while first aid was being administered to Child #1. Staff #2 (S2) assisted Child #1 with first aid, while Staff #1 retrieved the children from outside. Staff #1 rinsed the child’s finger with water and paper towels were applied to stop the bleeding. The Licensee took the child to the office, where the parents were called and an ice pack was applied to the injury. The child was picked up at approximately 9:40 AM and taken to the Sierra View District Hospital emergency room, where the child was diagnosed with a fracture and treated with a splint. The child returned to care on 11/20/2025. During the inspection, LPA conducted interviews with Staff #1, Staff #2, and the Licensee. LPA inspected the area where the child was injured and observed the door was metal and heavy. During a review of records, Continued on LIC 809C LPA observed Staff #1 is an aide and does not have teacher qualifications. LPA reviewed video footage of the playground the date the incident took place and observed seven children exit to the playground without the visual observation of a teacher. Exit interview conducted and report was reviewed with Licensee, Holly Oliveira. Appeal rights were provided. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see LIC 809D). LPA Nolan informed licensee that this report dated 12/04/2025 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Nolan informed the licensee to provide a copy of this licensing report dated 12/04/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee, Holly Oliveira. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

    RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by: based on observation, interviews, and records review, Staff #1 did not ensure children were at a safe distance prior to closing the door on a child's finger causing a severe injury. Staff also did not secure the door closed after the incident, allowing children to exit to the playground without a teacher present which poses an immediate health, safety or personal rights risk to persons in care.
