Based on observation, the licensee did not comply with the section cited above. LPA observed areas under slides and swings in the preschool play yard did not have enough woodchips to cushion falls. The woodchips were sparse and exposed the hard dirt under which poses a potential health, safety or personal rights risk to persons in care.

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by: based on observation, interviews, and records review, Staff #1 did not ensure children were at a safe distance prior to closing the door on a child's finger causing a severe injury. Staff also did not secure the door closed after the incident, allowing children to exit to the playground without a teacher present which poses an immediate health, safety or personal rights risk to persons in care.

101223(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement was not met when Director allowed staff to sound a loud alarm to frighten children in care as a form of punishment.
