OPERATION OF A FAMILY CHILD CARE HOME
Based on observation, the licensee did not comply with the section cited above as LPA observed a rabbit inside the bathtub with rabbit droppings in the bathroom. Turtles in the living without a cover and green water. There are areas in the living room, dining room and bathroom with Amazon packages, paper and mail clutter piled in small stacks in these areas, which poses a potential health, safety or personal rights risk to persons in care.

Staffing Ratio and Capacity (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement was not met as evidenced by: observation and interview. Today, LPA Ocegueda observed 9 children in care with only licensee present. Licensee confirmed the observation and stated she did not realize she had 9 children in care. This poses an immediate risk to the health, safety and or personal rights risks to persons in care.

LPA Ocegueda observed that there were two mini style play pens located in the hallway being used by infants today which were stained all over. Licensee confirmed the observation. This poses a potential risk to the health, safety and or personal rights risks to children in care.

(2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. Based on observation and interview licensee did not comply with the section cited above. Today, LPA observed an accessible play yard that had access to multiple hazardous items (rusted vehicles, sharp metals, building debris, gasoline cans, a deep trench, wiring, plant pruners) and other items. Per interview of licensee and multiple children, the yard and hazardous area was used as recently as this week. LPA took photos. This posed and poses an immediate risk to the health, safety and/or personal rights risks of children in care.

(4) Personal Rights.To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. Based on observation and interview, licensee did not comply with the section cited above. LPA observed children sleeping directly on a blanket and area rug causing children to be unconfortable and interfering with their sleep. Interviews revealed that a highly cluttered room is used for children to go to during "time out" for misbehaving. Today, Licensee confirmed that child #1 was inside that room yesterday. This poses a potential risk to the health, safety and or personal rights risks to children in care.

Reporting Requirements: Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. Licensee did not comply with section cited above. Today, LPA observed that children had access to the previously identified off limits kitchen. Interviews revealed that children have had access to two previuosly identified off limit bedrooms and play yard. This poses a potential risk to the health, safety and/or personal rights of children in care.

On 4/19/2023, during an inspection, Licensee could not provide completed roster. Licensee provided the completed roster on 5/30/2023. Today, it was observed that the accessible kitchen had cluttered counters. There was clutter on the furniture in the dining room. In the accessible bathroom, there were multiple toys that were to be discarded and stacked in the tub. The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. Licensee did not comply with the regulation stated above. Today, it was observed that the accessible kitchen had cluttered counters and clutter in the dining area as well as multiple toys in the tub. This poses a potential risk to the health, safety and or personal rights risks to persons in care.

This requirement was not met as evidenced by: record review, interview and observation. Adult #1 was observed cleaning and holding child #6. Licensee indicated; adult was a backup today due to regular assistant having a family emergency. This poses an immediate risk to the health, safety and personal rights to children in care. A $100.00 civil penalty was assessed

Based on observation and interview, the licensee did not comply with the section cited above. LPA observed that one of the two pool gates did not self latch as required. The licensee uses a key lock to maintan the pool gate closed. The pool gate faces a yard that is inacessble by gate to the children and has been documented to be off limits. Licensee confirmed this observation today. This poses an immediate health, safety or personal rights risk to persons in care.

Based on on observation and interview the licensee did not comply with the section cited above. LPA observed dirty dishes that piled the sink, the counters were cluttered and had many crumbs. The kitchen floor and counters were cluttered with food jars and other items making it difficult to properly clean and disinfect. LPA reviewed the requirement above and indicated that although the children did not have access to the kitchen, licensee reported she stores and cooks the children's meals in the kitchen, thus should be kept in a clean and orderly condition. This poses a potential health, safety or personal rights risk to persons in care.
