What the inspector wrote

On 10/16/2023 at 9:35am, an annual inspection was made to the facility by Licensing Program Analyst (LPA), Laura Chavez. At 9:50am the home was toured inside and outside. Upon arrival to the home LPA observed the licensee supervising 9 children without an assistant present. The licensee's assistant (A1) arrived at 10:37am. The facility\342\200\231s operating hours are 7:30am-5:30pm, Monday\342\200\223Friday. The floor plan submitted by the licensee was reviewed and verified. The off-limits areas of the home are the garage, laundry room, master bedroom/bathroom, Room #2, and Room #3 as designated on the Facility Sketch, and were made inaccessible by locks and doorknob covers. The children use the back yard as the outdoor play area and it is fully fenced. There were no pools or other bodies of water observed in the yard. Nine (9) children's records were reviewed at 10:20am. One staff record was reviewed at 10:50am. There are currently two adults living in the home. The following deficiencies were cited: CCR 102416.5((e), CCR 102417(g)(9)(A), CCR 102417(g)(8), CCR 102419(d)(1), CCR 102417(m)(3), HSC 1596.8662(b)(1), HSC 1597.622(a)(1)(see LIC 809D's): To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Licensee Maricela Silva was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. LPA discussed the safe sleep regulations with licensee Maricela Silva and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee Maricela Silva was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. During the exit interview, Maricela Silva, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee Maricela Silva.

    Based on children's record reviews, the licensee did not comply with the section cited above in 2 out of 9 file reviews which poses a potential health, safety or personal rights risk to persons in care.

    Based on a record review, the licensee did not comply with the section cited above in one out of nine children's file reviews which poses a potential health, safety or personal rights risk to persons in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    Based on an interview, the licensee did not comply with the section cited above. The licensee's Mandated Reporter Training has expired and her assistant (A1) certificate was not available for review which poses a potential health, safety or personal rights risk to persons in care.

    Based on a record review, the licensee did not comply with the section cited above in one out of one record review indicating that her assistant (A1) proof of measles vaccine was not available for review which poses a potential health, safety or personal rights risk to persons in care.
