Written exception request for prohibited conditions

87616 Exceptions for Health Conditions(a) ...the licensee may submit a written exception request if he/she agrees that the resident has a prohibited... health condition but believes that the intent of the law can be met through alternative means. This requirement was not met as evidenced by: based on record review and interviews, Licensee did not submit the proper paperwork to Community Care Licensing once it was believed that R1 had an unstageable wound. This is a potential health and safety risk to residents in care.

80019 Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1522 shall prior to working, residing or volunteering in a licensed facility: (2) Obtain a California clearance or a criminal record exemption as required by the Department or.......... :This requirement is not met as evidenced by: based on observation the licensee did not comply with the section cited above as individual (I1) was not cleared in Guardian and not associated with the facility. This poses an immediate health, safety or personal rights risk to persons in care.

Annual routine visit with medical professional

87463 Reappraisals (h) The licensee shall request that all residents receive an annual routine visit with a licensed medical professional once every twelve months, either in person or by video appointment. This requirement is not met as evidenced by: Based on document review, the licensee did not comply with the section cited above with R1 not receiving an annual routine visit with a licensed medical professional once every twelve months as their last one is dated 02/14/2024 which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above with one out of one walls being damaged/cracked, approximatley 27 inches in height and 17 inches in width which poses/posed a potential health, safety or personal rights risk to persons in care.

Food quality controls and rejected damaged goods

Based on LPAs observations, the Licensee did not comply with the section cited above. LPAs observed expired food cans in the pantry, and and expired yogurt, moldy sausages, and unlabelled and uncovered meals in facility fridges. LPAs observed Facility staff immediately discard expired and moldy food. This poses an immediate health, safety or personal rights risk to persons in care.

Maintain fire clearance before retaining specified persons

Based on LPAs observations, the Licensee did not comply with the section cited above. LPAs observed 3 of 5 exits obstructed by resident belongings. Bedroom 1's exit was obstructed by a night stand and lamp, Bedroom 5's exit was obstructed by a night stand, lamp, and dresser, and Facility's living room exit was obstructed by an assistive walking device. Facility immediately moved items. This poses an immediate health, safety or personal rights risk to persons in care.

Maintain facility in clean, safe, sanitary condition

Based on LPAs observations, the Licensee did not comply with the section cited above. LPAs observed the following: construction items discarded by the side of the house, mold located on house exterior, wood rot on roof, facility ceiling observed to be caving in, bathroom tiles were moldy and in need of replacement. This poses a potential health, safety or personal rights risk to persons in care.

Notify agency before locking doors or gates

Based on LPAs observations, the Licensee did not comply with the section cited above. LPAs observed knives and other sharp objects in an unlocked drawer in the kitchen accessible to residents in care. This poses an immediate health, safety or personal rights risk to persons in care.

Fire approval and staff access to unlock systems

Based on LPAs observations, the Licensee did not comply with the section cited above. LPAs observed cleaning supplies and toxins in residents' bathroom that were unlocked and accessible to residents in care. This poses an immediate health, safety or personal rights risk to persons in care.

Maintain facility in clean, safe, sanitary condition

87303 Maintenance and Operation (a) The facility shall be clean, safe, sanitary and in good repair at all times. This requirement has not been met as evidence by: Based on LPA’s observations, records review and interviews with licensee & outside parties, the facility did not ensure to keep resident’s bathrooms clean, safe, sanitary and in good repair at all times which poses an immediate risk to the health and safety to residents in care.

§1569.269 (a)(6) Enumerated rights (a) Residents of RCFE shall have all of the following rights: (6) To care, supervision & services that meet their individual needs & are delivered by staff that are sufficient in numbers, qualifications & competency to meet their needs. This requirement has not been met as evidence by: Based on LPA records review and interviews, the facility staff did not follow their house rules, weekly staff schedule task procedures and R1’s Physician’s report about resident’s care needs which poses an immediate risk to the health and safety of residents in care.

Encourage resident participation in varied planned activities

87219 Planned Activities: (a) Residents shall be encouraged to maintain and develop their fullest potential for independent living through participation in planned activities…This requirement has not been met as evidenced by: Based upon interviews, observations and records reviewed, the facility did not ensure to provide recreational activities as required by regulation. This poses a potential risk to the health and safety of resident’s in care.

87466 Observation of the Resident - (a)The licensee shall ensure that residents are regularly observed for changes in physical…& that appropriate assistance is provided when such observation reveals unmet needs...This requirement has not been met as evidence by: Based on LPA records review and interviews with licensee, the facility did not ensure to seek medical treatment for R1 after observed rash and bruising in resident’s body which poses an immediate risk to the health and safety of the residents in care.

Based on LPA observation, record review and interview with Licensee did not ensure to obtain a criminal record clearance for staff (S1) prior to work, reside or provide care to residents in care which poses an immediate health, safety and personal rights risk to residents in care. ***Civil Penalty is being assessed for the amount of $100 per day.

Maintain facilities for fire and panic safety

87203 Fire Safety - All facilities shall be maintained in conformity with the regulations adopted by the State Fire Marshal for the protection of life and property against fire and panic. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in 2 out of 2 fire extinguisher was charged but not serviced which poses an immediate health, safety or personal rights risk to persons in care.
