This requirement was not met as evidenced by interviews conducted and disclosures made indicating that Staff were provided with only emails regarding infant safe sleep practices which poses a potential health, safety, and personal rights to children in care.

    101223(a)(2) Personal Rights To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by by interviews conducted and disclosures made indicating that Child #1 was crying, swaddled, placed in a swing, and a blanket was placed over the swing prior to Child #1 falling asleep. When Child #1 woke up crying, Child #1 was placed in the crib to “cry it out” which poses an immediate health, safety, and personal rights risk to children in care.

This requirement is not met as evidenced by LPA observing that Infant Room A (Child #1s classroom) on 01/18/23, did not have a working light switch. The lights in the nap area were not coming on when flicking the light switch. LPA was informed thatthe light switch indeed does not work which poses a potential health, safety or personal rights risk to children in care.

This requirement is not met as evidenced by: Based on observations, interviews, and review, While inspecting the sleep area on 01/18/23 in Room Toddler C, LPA Miranda observed that Staff #6 was singularly caring for 7 infants. In interviewing staff, Staff #10 confirmed that they left Staff #6 to singularly care for the 7 infants due to Staff #10 leaving for a 1-hour lunch break. On 01/18/23 LPA observed that 3 infants were awake in the Toddler C and 4 infants were napping in the nap area which poses an immediate health, safety or personal rights risk to children in care.

    101429(B) Responsibility for Providing Care and Supervision for Infants: Staff shall physically check on sleeping infant(s) every 15 minutes and document the following: 1. Labored breathing, 2. Signs of distress, which includes but is not limited to flushed skin color, increase in body temperature and restlessness. 3. Infants up to 12 months of age who are sleeping in a position other than on their back. This requirement is not met as evidenced by LPAs record review and observation on 01/18/23 that the infant sleep log for Child #1 was not updated. Staff #1 and Staff #2 confirmed that the log was not up to date on safe sleep log 01/18/23. Also, LPA observed that Classrooms Toddler A, B and C were not documenting the napping time on safe sleep log. This poses a potential health and safety risk to children in care.

    101429 Responsibility for Providing Care and Supervision for Infants. (D) In the event a separately walled room is used as a designated sleeping area, staff must adhere to the staff-infant ratio requirements, as specified in Section 101416.5(d), unless there is a half-wall or transparent wall that allows for constant audial and visual supervision. This requirement is not met as evidenced. On 01/18/23 LPA observed that 3 infants were awake in room Toddler C and 4 infants were napping in the nap area. There is a half wall in Room Toddler C, however, the second half of the wall is covered with a black curtain which prevents not just physical but also visual supervision (pictures were taken). which poses an potential health, safety or personal rights risk to children in care.

    Indoor Activity Space for Infants:The calculation of indoor activity space for infants shall not include space designated and used for cribs. The sleeping area for infants shall be physically separate from the indoor activity space. This separation shall be accomplished as specified in (b) above. . This requirement is not met as evidenced by LPA Miranda, on 01/18/23. LPA observed classrooms, Toddler Room A and Toddler Room B, using the classrooms play space as the nap area. LPA informed the Director that the nap area needs to be separate from the indoor play area (pictures were taken). which poses a potential health, safety or personal rights risk to children in care.

    101439.1 Infant Care Center Sleeping Equipment. (g) Cribs, mats or cots shall be arranged so as to provide a walkway and work space between the cribs... This requirement is not met as evidenced by LPA observing on 01/18/2023 that the cribs in Infant Room A are placed side by side without providing a walkway andworkspace between the cribs which poses a potential health, safety, and personal rights to children in care.

This requirement is not met as evidenced by LPA observing that Staff #3, #5,#6,#7#8, #9 and #10 were present on 01/18/2023 and caring for children. Staff #3, #5,#6,#7#8, #9 and #10 do not have a criminal record transfer which poses an immediate health, safety, and personal rights of children in care.
