    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation...This requirement was not met as evidenced by: Based on interviews C1 was instructed on how to clean themselves by S3 from the doorway of the restroom after having a potty incident, which resulted in C1 being in the restroom for approximately 30 to 40 minutes attempting to clean themselves with wet paper towels.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time,(1). Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews the facility is meeting ratio requirements,however S2 needs assistance during tranisions and diaper changes which poses a potential health, safety or personal rigths risk to children in care.

  • HEALTH-RELATED SERVICES

    Based on observation, C1 is prescribed albuterol that was not in its original packaging and prescription which poses a potential health, safety or personal rights risk to persons in care.

  • OUTDOOR ACTIVITY SPACE

    Based on observation, the licensee did not comply with the section cited above LPA's observed two empty rectangular planters that were occupied by sitting water. Director quickly emptied both containers which posed a potential health, safety or personal rights risk to persons in care.

    FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    Based on observation, LPA's observed a broken bicycle and broken kitchen that obtained sharp edges. Director removed all broken items while LPA's were present which posed a potential health, safety or personal rights risk to persons in care.

    "The licensee shall obtain emergency medical treatment without specific instructions from the child's authorized representative if...the nature of the child's...injury is such that there should be no delay in getting medical treatment for the child." This requirement was not met as evidenced by: Staff witnessed child become unconcious and shake but immediate medical attention was not obtained. This poses a potential health, safety, or personal rights risk to the children in care.

In addition, a written report...shall be submitted...within seven days following the occurrence of...Any injury to any child that requires medical treatment." This requirement was not met as evidenced by: The department did not receive notification - verbal, written or otherwise - disclosing that a child had suffered an injury that resulted in medical attention.
