CRIMINAL RECORD CLEARANCE
Based on the record review, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During the review of the facility staff associations list, the LPA was unable to an association for S1. S1 was observed to be providing Care & Supervision during the facility tour. Licensee stated the paperwork for S1 had not been sent over to Licensing.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. This requirement was not being met as evidenced by the receipt of the incident reports, which was, 3 days after their occurrence, and knowledge of them occurring. This poses a potential risk to the Health and Safety of children in care.

Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement was not being met as evidenced by a staff member being present, at the facility, without a criminal record clearance or associated to the facility license. This poses an immediate risk to the Health and Safety, Personal Right of the children in care.A $500.00 civil penalty was also issued with this citation.

Food Services(7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This requirement was not met as evidenced by: Based on the interviews and record review, the Licensee did not meet Food Services regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the interviews it was disclosed that staff were aware of Child 1 food allergy. However, staff provided food to the child.

This requirement was not met as evidenced by: Based on the interview, the Licensee did not meet the Personal Rights regulation which poses an potential Health, Safety & Personal Rights risk to the children in care. Pertinent parties disclosed that the child was grabbed by the shirt to stop him/her from running out of the classroom while maintaining supervision of the child(ren) in the restroom.
