BUILDINGS AND GROUNDS.The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidenced by: Based on LPA's observation, the fencing located at the entrance and play area were observed to be corroded, rusted and chipping.

PERSONNEL REQUIREMENTS

Based on record review, the licensee did not comply with the section cited above as the opening and closing staff does not have a valid EMSA approved pediatric CPR and First Aid card which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above as 4 out of 6 staff records reviewed online mandated chld abuse training certificates had expired which poses/posed a potential health, safety or personal rights risk to persons in care.

DISASTER AND MASS CASUALTY PLAN

Based on record review, the licensee did not comply with the section cited above in as facility has not conducted a fire drill with the children since 12/13/2022. Which poses/posed a potential health, safety or personal rights risk to persons in care.

California Lead Action Level at Child Care Centers. (b) Testing results with...readings of 5.5 ppb or greater..., before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement is not met as evidenced by: Based on testing report and interview, the licensee did not comply with the directive above, as two out of six of the water outlets located at Site D and E tested with an Action Level Exceedance (ALE). This poses a potential Health and Safety risk to children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

Responsibility for Providing Care and SupervisionThe licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidence by LPA's observation that a day care child that had to use the restroom and the seven children that was napping in the Koala Room were left without visual supervision. This poses a potential health and safety risk to clients in care.

TEACHER AIDE QUALIFICATIONS AND DUTIES

Teacher Aide Qualification and Duties: An aide shall work only under the direct supervision of a teacher. This requirement is not met as evidence by: LPA Siaoobserved teacher aides Zahra Ahmadkhah and Shahrbanoo Mousavi were supervising 7 toddlers at the toddler playground while the toddler teacher Ledy Rodriguez went to the restroom. This poses a potential health and safety risk to clients in care.

Outdoor Activity Space: As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. This requirement is not met as evidence by: LPA Siao inspected the toddler playground and the sand areas around and under the climbing structure and two slides are compacted and does not have sufficient cushioned to absorbs falls. This poses a potential health and safety risk to clients in care.

H&S 1596.8662(4)(b)(1)Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter who is licensed day care provider, administrator, or employee of a licensed child day care facility; proof of completion. This requirement is not met as evidence by 8 out of 12 staff member's mandated child abuse training certificates are not available for review. This poses a potential health and safety risk to clients in care.

ARTICLE 1. General Provisions and Definitions

Employees or volunteers at day care center; immunization requirements; records; exemptions- (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidence that 6 out of 12 staff members did not have their required immunizations available for review today. This poses a potential health and safety risk to clients in care.
