1596.817 (a) When the department conducts a site visit of a licensed child day care facility, the department shall post on, or immediately...adjacent to the postings required pursuant to section 1596.8595, a notice...that includes all of the following: (1) The date of the site visit.(2) Whether the facility was cited for violating...regulations...of the following categories was cited: (A) A violation that, if not corrected, will have a direct and immediate risk to the health, safety, or personal rights of children in care.This requirement is not met as evidenced by:Based on observation, LPA determined that a copy of the licensing report was not posted anywhere in the faclity.

ARTICLE 2. Administration of Child Day Care Licensing

(c)(1) A licensed child day care facility shall provide to the...guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care...(3) The licensee shall require each recipient...to sign a statement indicating that he or she has received the document and the date it was received. (4) The licensee shall keep verification of receipt in each child's file.This requirement is not met as evidenced by:Based on record review, LPA reviewed the records of all the enrolled infants and none of the files included a LIC 9224 form, acknowledging the receipt of licensing reports.

INFANT CARE TEACHER QUALIFICATIONS AND DUTIES

(b) Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university. This requirement is not met as evidenced by:Based on file review, LPA determined that none of the staff currently caring for infants has completed three postsecondary semester or equivalent quarter units related to the care of infants, which poses an immediate health, safety or personal rights risk to persons in care.

POSTING OF LICENSE

101160 Posting of License(a) The license shall be posted in a prominent, publicly accessible location in the center.This requirement is not met as evidenced by: Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that the license is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

(g) All personnel...(1)Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement is not met as evidenced by:Based on file review, LPA determined that one staff is without verification of tuberculosis clearance, which poses an immediate health, safety or personal rights risk to persons in care.

ADMISSION PROCEDURES AND PARENTAL AND AUTHORIZED

(c) The licensee shall post the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster in a prominent, publicly accessible area in the child care center at all times.This requirement is not met as evidenced by: Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidenced by:(b) The center shall inform each child's authorized representative of the rights specified in (a) (1) through (8) above.(2) The center shall post a copy of the LIC 613A Personal Rights Form (9/96) in a prominent, publicly accessible area in the center. Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that LIC 613A Personal Rights is not posted in a prominent, publicly accessible location which poses a potential health, safety or personal rights risk to persons in care.

(f) The licensee shall post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5 This requirement is not met as evidenced by:Based on interview with assistant director and observation of the area where parents pick up and drop off children. LPA determined that the telephone number of the local health department and information on child passenger restraint systems are not posted in an area regularly accessible to parents and caregivers which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 1. General Provisions and Definitions

(a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. Bas record review, the licensee did not comply with the above by not maintaining immunization records for all staff working with infants which poses a potential risk to the health, safety, or personal rights of infants in care.ed on

TEACHER QUALIFICATIONS AND DUTIES

(1)A teacher shall have completed, with passing grades, at least six...semester or equivalent quarter units of the education requirement specified in (c)(1) below (A)After employment, a teacher hired under (b) above shall complete, with passing grades, at least two units each semester or quarter until the education requirement specified in (c)(1) below is met. This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the above by not completing the required equivalent semester units and not maintaining continuous enrollment records available for review which poses a potential risk to the health, safety, or personal rights of children in care.

PERSONNEL RECORDS

(d) All personnel records shall be maintained at the child care center and shall be available to the licensing agency for review.This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the above by not maintaining complete personnel records available for review which poses a potential risk to the health, safety, or personal rights of children in care.

INFANT CARE ACTIVITIES

Based on observation, the licensee did not comply with the section cited above by using sleep sacks for napping infants which poses a potential health, safety or personal rights risk to persons in care.

PERSONNEL RECORDS

Based on interview and record review, the licensee did not comply with the section cited above by not having staff files available for review which poses a potential health, safety or personal rights risk to persons in care.

CRIMINAL RECORD CLEARANCE

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2)Request a transfer of a criminal record clearance as specified in Section 101170(f)This requirement was not met as evidenced by: Based on record review it was found that 5/7 staff were not associated to the facility. This poses a potential health and safety risk to children in care.

ARTICLE 3. Administration

(a) (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test.This requirement was not met as evidenced by: Based on record review facility has not completed the required lead testing. This poses a potential health and safety risk to children in care.
