PERSONAL RIGHTS

Personal Rights. (a) Each child receiving services ... certain rights that shall not be waived...(1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement was not met based on the following:. Based on the observation/interview/records reviews Licensee's failed to provide a safe setting for Child #1 as Child #1 was bit by Licensee's dog.This poses a potential risk to the health, safety and personal rights of persons in care.

Based on observation and interview , the licensee did not comply with the section cited, during today's inspection there were total of 16 children in care, licensee also admitted that she has been caring for the same no. of children since Monday, 4/21/2025, 4/22/2025 and 4/23/2025 because Elementary school district is on spring break. This poses an immediate health, safety or personal rights risk to persons in care.

IMMUNIZATIONS

Based on record review , the licensee did not comply with the section cited above, child # 3 does not have immunization record on file which poses/posed a potential health, safety or personal rights risk to persons in care.

Family Day Care Homes

Based on record review, the licensee did not comply with the section cited above , Staff 2 and Staff 3 do not have immunization record which poses/posed a potential health, safety or personal rights risk to persons in care.

IMMUNIZATIONS

Based on record review, the licensee did not comply with the section cited above, 8 day care children's immunization record is not documented on PM 286 which poses/posed a potential health, safety or personal rights risk to persons in care.

INFANT SAFE SLEEP

Based on, the licensee did not comply with the section cited above in 3 out of 3 infants do not have LIC 9227 Individual Safe Sleep Plan on file which poses/posed a potential health, safety or personal rights risk to persons in care.

Upon presenting identification, the parent or authorized representative of a child in care has the right to enter and inspect the family child care home without advance notice during the family child care home's normal operating hours. LPA observed at 2:49pm, there was a knock at the door, the assist open, closed the door, walked over to the day-care area in the family room picked up C2, walked back to the front door opened the door handed C2 to mother, closed the door, walked back to the day-care area/family room, obtained C2's blanket, and backpack, walked back to the front door and hand the mother C2's belongings, while the mother waited outside the doorThis poses an immediate risk to health, safety or personnel rights of persons in care.

STAFFING RATIO AND CAPACITY

For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either:(1) Twelve children, no more than four of whom may be infants; or LPAs observation reveal that Licensee cared for more than fourteen (14) at once during 06/02/2023, and 02/06/2024. This poses an immediate risk to health, safety or personnel rights of persons in care.

Revocation or Suspension of a license or registration. Licensee submitted a falsified documentation to receive services for children. Licensee admitted to LPA's that Licensee completed the Child Care Attendance logs for Santa Barbara County of Education. Per regulation, licensee will conduct in the operation or maintenance of a family day-care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California. This possess an immediate health and safety risk to children in care.

The home shall provide safe toys, play equipment and materials. 1024417(d)(1) Fixtures, furniture and equipment that have been banned or recalled by the United States Consumer Protection Safety Commission shall not be used for children in care or accessible to children in care. This requirement is not met as evidenced by: LPA observed an infant walker in the backyard play area. This poses a potential risk to health and safety of children in care.

For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either:(1) Twelve children, no more than four of whom may be infants; orThis requirement is not met as evidence by: Licensee had 5 infants and 15 children in care at the time of the inspection. This poses an immediate potential Health and Safety risk to children in care.
