    Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting... This requirement is not met as evidenced by: S1 removed food from a child before they were complete and attempted to move the child to the rug without child's consent. This poses an immediate risk to the health and safety of children in care.

    101216.3 Teacher-Child Ratio(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Based observation conducted, LPA observed 18 children left with music staff without fully qualified teachers present in the room which poses an immediate risk to the health, safety and personal rights of children in care.

    101216.3 Teacher-Child Ratio(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Based on interview, LPA learned that one teacher was supervising 18 children while another staff took a bathroom break which places the classroom out of ratio.This poses an immediate risk to the health, safety and personal rights of children in care.

  • REPORTING REQUIREMENTS

    101212 Reporting Requirements (d) (1) Upon the occurrence... a report shall be made to the Department ... within the Department's next working day.... a written report containing the information ... shall be submitted to the Department within seven days following the occurence of such event. (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement is not met as evidenced by: LPA observed that incident was reported to parent but reporting requirements to the Childcare Licensing Department were not followed.

    Responsibility for Providing Care and Supervision. The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement was not met as evidenced by: Based on observation, LPAs observed that a child was behind the slide of the play structure. A staff did went over to the child. There were two staff present, but cannot visually see the child from where they were positioned. This poses a potential health and safety risk to children.
