    Responsibility for Providing Care and Supervision 101229(a)(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement was not met as evidenced by: Based on LPA observations and interview, the licensee did not comply with the section cited above as a child was left unsupervised in the yard, which posed an immediate threat to the health and safety of the child in care.

    Section 101212(d) upon the occurrence, during the operation of the childcare center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement is not met as evidenced by, LPA's Record Review, a UIR copy was email to the Regional Office email on 5/19/2024 at 3:04 pm with an lack of supervision incident that took placed on 5/9/2024 which pose an potential risk to the health, safety or personal rights to children in care.

    Section 101229 (a)(1) that no child shall be left without the supervision, including visual supervision, of a teacher at any time. This requirement is not met as evidenced by, LPA Record Review, Unusual Incident Report (UIR) LIC 624 dated 5/17/2024, showed that on 5/9/2024 at 10am, C1 left unattended in a small room outside of C1's classroom corridor in between classroom and outdoor space for 2-3 minutes which pose an immediate risk to the health, safety or personal rights to children in care.

    Based on observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA observed 5 staff members have an expired mandated dated reporter certificate. Director stated that staff members forgot that it needed to be renewed.

    (a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference wiith... sleeping...This requirement was not met as evidenced by: Director stated that facility teacher forced a child to leave a sleeping cot and used inappropriate tones of voice (described as "harsh" and "punitive") towards daycare children. This poses an immediate risk to the health and safety of children in care.
