PERSONNEL REQUIREMENTS

Based on record review, the licensee did not comply with the section cited above in when the licensee had an expired CPR & First Aid Certification as of 06/2024 which poses/posed a potential health, safety or personal rights risk to persons in care.

As soon as possible but no later then the same business day, the licensee shall notify a child's parent or authorized representative regardless of the injuries or acts that affect that child as specified in Health and Safety Code Section 1597.467(a). This requirement has not been met as evidenced by: Based on evidence recieved, that the licensee failed to report an injury to a parent. It was later determined C1 may have injured their leg playing on the bricks in the backyard. Which poses a potential risk to the Health, Safety or Personal Rights to children in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above in when doing file reviews and observed the licensee's mandated reporter is currently expired as of 05/2024 which poses/posed a potential health, safety or personal rights risk to persons in care.

(a) ...These rights include, but are not limited to, the following: ... (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature....This requirement has not been met as evidence by: when the parent of (C1) came to the facility during pickup and observed their infant child being placed in a headlock by a school aged child (C3) which poses an immediate health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

102423 Personal Rights (a) Each child receiving services from a family child care home shall have certain rights... (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement has not been met as evidenced by: Based on interview, the licensee did not comply with the section cited above when staff served an infant cow's milk and due to the infant's age a known allergen which posed an immediate risk to the health, safety or personal rights of children in care.

This requirement has not been met as evidenced by: Based on interviews with licensee, the licensee stated that they did not report the child's injury to the parent due to the Licensee not being present in the home during the time of incident which poses a potential risk to the Health, Safety or Personal Rights to children in care.

102416.2 Reporting Requirements (b)The licensee shall report to the Department... (3)(B)Any injury to any child that requires medical treatment.This requirement has not been met as evidenced by: Licensee did not report an incindent where a daycare child received medical treatment for an injury sustained while in care which poses a potential risk to the Health, Safety or Personal Rights to children in care.

OPERATION OF A FAMILY CHILD CARE HOME

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to:(4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement was not met as evidenced by: When a child's medicine was lost, the licensee stated that the children woke up from their nap and "got into things" whichposes a potential risk to the Health, Safety or Personal Rights to children in care.

Any duly authorized officer, employee, or agent of the Department shall, upon presentation of proper identification, enter and inspect any place providing personal care, supervision, and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation of, the regulations adopted by the Department governing family child care homes, and in accordance with Section 102396. This requirement was not met as evidenced by:LPAs were not allowed into the home while daycare children were present which poses an immediate risk to the Health, Safety or Personal Rights to children in care.

102416.2 Reporting Requirements (c)...the licensee shall report the following events to the Department: (3) A communicable disease outbreak...This requirement has not been met as evidenced by: Based on interview, the licensee did not comply with the section cited above when licensee did not report to licensing when children were sick with the flu which poses an potential risk to the health, safety or personal rights of children in care.
