LIMITATIONS ON CAPACITY

101429 Responsibility for Providing Care and Supervision for Infants(a)..., the following shall apply:(2) Sleeping infant(s) shall be directly observed by sight and sound at all times.(C)Documentation... shall include the following: 3. Time of each 15-minute check. The requirement was not met as evidenced by: LPA observed multiple sleeping infants from approximately 9:45am - 10:40am. LPA reviewed Infant sleep charts (hardcopy and on ProCare app). LPA observed documentation for sleeping infants missing for all sleeping infants.

101430 Infant Care Activities(a)..., the following shall apply:(3)All infants shall ...(A)Staff shall place infants up to 12 months of age on their backs for sleeping.4.Infants with an Individual Infant Sleeping Plan...a. Upon staff observation... the provider shall fill out Section D ... The requirement was not met as evidenced by: LPA observed C1 asleep on their stomach. LPA reviewed LIC 9227 and observed Section D missing signatures from providers.

(2) Sleeping infant(s) shall be directly observed by sight and sound at all times.(B) Staff shall physically check on sleeping infant(s) every 15 minutes and document the following: 1. Labored breathing. 2. Signs of distress, which includes but is not limited to flushed skin color, increase in body temperature and restlessness. 3.Infants up to 12 months of age who are sleeping in a position other than on their back. a. If the infant’s Individual Infant Sleeping Plan [LIC 9227 (3/20)] does not have Section C completed, staff shall return the infant to their back for sleeping. 4. If staff observes labored breathing or signs of distress.......(C) Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following:1. Date.2. Infant’s name.3. Time of each 15-minute check.4. Initials of staff person whoconducted each check. The requirement was not met as evidenced by: LPA Clayton's review of the 6 infants files, and Licensees and Director's admission that they have been using a Sleep Log to document checking on the infants every 15 minutes as stated in the regulation, which poses a Health and Safety risk to children in care.

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working,.....in a licensed facility:(1)Obtain a California clearance or a criminal record exemption as required by the Department (2)Request a transfer of a criminal record clearance........ (3) Request and be approved for a transfer of a criminal record exemption, ......... Department permits the individual to be employed, reside or be present at the facility. This requirement was not met as evidenced by: LPA Clayton's review of Guardian and observed staff fingerprint submission determination status "in process" since June 2025, which poses an immediate Health and Safety risk to children in care.

(n) Furniture and equipment shall be maintained in good condition,....... (1) A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c). (b) A baby walker shall not be kept or used... facility.(c) A "baby walker" means any article described in paragraph (4) of subdivision (a) of Section 1500.86 of Part 1500 of Title 16 of the Code of Federal Regulations. This requirement was not met as evidenced by: LPA Clayton observation of a baby walker and a bouncy seat observed on the premises, which poses an immediate Health and Safety risk to children in care.

(a) Prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. (b) The needs and services plan......include the following: (1)The individual feeding plan. (2) Infants up to 12 months of age shall have a completed Individual Infant Sleeping Plan [LIC 9227 (3/20)], which is incorporated by reference. The requirement was not met as evidenced by: LPA Clayton's review of the 6 infants files, and Licensees and Director's admission that they have not created the Infant needs and Services Plans and no Individual Infant Sleeping plans were present which posed a Health and Safety risk to children in care.
