LPA noted that the licensee`s bedroom , which is adjacent to the living room (day care are), has access to the pool through sliding doors located in the bedroom. Additionally, LPA observed detached garage located in the outdoor play area, which had a side door with access to the pool.

102416.3(a) Alterations to Existing Buildings or Grounds(a) Prior to making alterations or additions to a family childcare home or grounds, the licensee shall notify the Department of the proposed change.This requirement is not met as evidenced by: Licensee changed the gate to the in-ground pool without notifying Department. LPA reviewed pictures of the gate on the file which is different from the existing gate .LPA observed different gate which did not match pictures on the file . Licensee stated she made a change in 2024 and gate was altered.

Based on observations, measurements and interiew , LPA observed gap between wall and gate 4 inches, observed opening between gate and the ground 4 inches, observed board and posters blocking pool view, observed iron rods making gate climable, did not observe pool alarm ,which poses an immediate health, safety or personal rights risk to persons in care.
