    Based on observation, the licensee did not comply with the section cited above in LPA observed the floor was full of debris including a dirty diaper, and there was exposed wood at the bottom of the fence. LPA also observed some areas of the floor did not have material that will absorb a fall, several plastic bags, and a piece of cement which poses/posed a potential health, safety or personal rights risk to persons in care.

    Based on observation, the licensee did not comply with the section cited above in LPA observed the playground structure has spider webs, the elephant in the middle of the playground is deteriorated and has a crack, the wood playhouse has exposed nails, and tricycles had rust. LPA also did not observe enough toys or equipment for children in care which poses/posed a potential health, safety or personal rights risk to persons in care.

    101216.3 Teacher-Child Ratio: (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement is not met as evidenced by: LPA’s interview disclosure confirmed by staff that incident took place years ago where Staff #3 was left with 13-15 children alone in the classroom providing the care and supervision of children in care. This poses a potential health and safety risk to children in care

    101227-Food Services:(a)In child care centers providing meals to children, the following shall apply: (1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children..... All food shall be selected, stored, prepared and served in a safe and healthful manner. This requirement is not met as evidenced by: Based on LPA's observations made on 07/26/2022- expired food; flour tortillas with a best before date of 07/20/22, cream cheese with a best when used by date of 06/21/22, butter with an expiration of 11/29/19, Frozen chicken/cheese taquitos with a best by date of 3/13/22. This poses a potential health and safety risk to children in care.

This requirement is not met as evidenced by: Based on observations made on 07/26/2022, LPA García observed that the facility uses 3-ounce cups to serve preschool age children milk and the facility did not have a reserve of milk in quantities to meet the needs of children in care.     101226-Health-Related Services: (e) In centers where the licensee chooses to handle medications: (2) All prescription and nonprescription medications shall be maintained with the child's name and shall be dated. This requirement was not met as evidenced by: In review of stored medication, LPAobserved that Child # 1 has and expired Vit A, C & D, Child #2 has expired Ibuprofen and Child #3 has expired Acetaminophen. This poses an immediate health and safety risk to children in care.

  • ARTICLE 1. General Provisions and Definitions

    1596.7995-Employees or volunteers at day care center; immunization requirements; records; exemptions: (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by LPAs staff records review of Staff #1, #2, #3 and Staff #4 do not currently have immunization documentation. This is a potential risk to the health and safety of children in care.
