RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

(a)(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement was not met as evidenced by: Based on record review and interview, there were at least 3 incidents where a child in care sustained a minor injury and no facility staff visually observed the child during the incident. This poses/posed an immediate health, safety, or personal rights risk to person in care.

ARTICLE 2. Administration of Child Day Care Licensing

Based on record review the licensee did not comply with the section cited above in that Staff 1 (S1), S2, & S5 did not have proof of updated Mandated Reporter Training, which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL RECORDS

Based on record review: Staff 1 (S1), S2, & S3 did not have a signed LIC9052 form, S1 & S3 did not have LIC503 form available to review, and S2 did not have a signed LIC501 form available to review, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above in that there were items with labels that stated to call poison control if ingested, including "lysol" spray, "off" bug spray, and "raid" bug poison. LPA observed these items stored out of the reach of children, but not stored behind a lock, which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Licensure Requirements

Based on observation and interview with the facility represetative Yahaira Martinez, the licensee did not comply with the section cited above in that they could not determine the location of the carbon monoxide detector for the LPA to test, which poses an immediate health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

(b) The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). Based on the interview and record review, the Licensee did not meet the above regulation which poses a potential Health, Safety & Personal Rights risk to the children in care. Based on observation, the licensee did not comply with the section cited above, LPA observed the carpeted areas and rugs in the classrooms and throughout the facility to having staining of grim and dirt which poses a potential health, safety or personal rights risk to persons in care.

Criminal Record Clearance Requirements - Initial Clearance

Based on record review, the licensee did not comply with the section cited above in 1 out of 22 staff criminal clearances, which poses an immediate health, safety or personal rights risk to persons in care.

Personnel Records. The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: Documentation of the educational background, training and/or experience specified in this chapter. This requirement is not met as evidenced by: Complete transcripts for Staff 7 who is hired as a teacher is not available for review during inspection. Director and the staff member state that there are no other records maintained at the facility to verify teacher's qualifications.
