ARTICLE 2. Administration of Child Day Care Licensing

Based on record review, the licensee did not comply with the section cited above in 2 out of 8 staff which poses a potential health, safety or personal rights risk to persons in care. Staff #2 and #7 have expired Mandated Reporter Training.

Based on record review, the licensee did not comply with the section cited above in 3 out of 10 children's files that were reviewed which poses a potential health, safety or personal rights risk to persons in care. The infant needs and services plan for Child #3, #4, and #5 are not updated quarterly.

PERSONAL RIGHTS

Personal Rights (a) (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interviews conducted, staff have been observed to shake children and tap them on their forehead when not listening. This poses an immediate risk to the health, safety and personal rights of children in care.

PERSONAL RIGHTS

Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement is not met as evidenced by: Based on interviews conducted, staff have been observed to yell at children when they are not listening to staff. This poses an immediate risk to the health, safety and personal rights of children in care.

PERSONAL RIGHTS

Personal Rights (a) (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidenced by: Based on interviews conducted, staff have been observed to take away children’s snack, food or chair if they are not listening and cause the children to be upset. Staff have been observed to take away child’s bedding, throw it aside and have them stand up as a form of punishment when not napping. Staff have been observed to inform children that they will not be picked up by parents as a form of punishment. This poses an immediate risk to the health, safety and personal rights of children in care.

INFANT CARE TEACHER QUALIFICATIONS AND DUTIES

Infant Care Teacher Qualifications and Duties. Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university.This requirement is not met as evidenced by: Based on record review, S-1 and S-2 were in Room 3B. S-1 has proof of completion of 5.5 units. S-2 does not have completion of at least 3 units in care of infant. This poses a potential health and safety risk to children in care.

INFANT CARE TEACHER QUALIFICATIONS AND DUTIES

Infant Care Teacher Qualifications and Duties. Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university.This requirement is not met as evidenced by: Based on record review, S-1 has proof of completion of 4 semester units. S-1 is enrolled in courses and is awaiting final grade, which poses a potential health and safety risk to children in care.

PRESCHOOL PROGRAM WITH TODDLER COMPONENT

PRESCHOOL PROGRAM WITH TODDLER COMPONENT. The toddler program shall be conducted in areas physically separate from those used by older or younger children...This requirement is not met as evidenced by: Based on observation, at 11:25AM, a staff brought preschool children to the toddler restroom. LPA observed that there was a toddler and staff in the restroom at the same time. This poses a potential health and safety risk to children in care.

Teacher-Child Ratio.A ratio of one fully qualified teacher (as specified in Section 101216.1(c)) and one aide for every 18 children in attendance in a preschool program is allowed when the aide meets the qualifications specified in Section 101216.2(d).This requirement is not met as evidenced by: Based on observation, LPA observed that S-3 and S-4 were with 24 children in the R2 Playground Preschool. S-3 is fully qualified. S-4 has proof of completion of 4 semester units and proof of enrollment in additional courses. S-4 is awaiting grade for additional courses. This poses a potential health and safety risk to children in care.

Infant Care Teacher Qualifications and Duties. To be a fully qualified infant care teacher, a teacher shall have the following: Completion, with passing grades, of 12 postsecondary semester or equivalent quarter units in early childhood or child development education at an accredited or approved college or university.At least three of the units required in (c)(1) above shall be related to the care of infants or shall contain instruction specific to infants.This requirement is not met as evidenced by: Based on record review, S-1 has transcript from an international university, which was not reviewed. This poses a potential health and safety risk to children in care.

TEACHER-CHILD RATIO

Teacher-Child Ratio. The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance.This requirement is not met as evidenced by: Based on record review, S-2 and S-3 were present in Room 1 with 16 children. S-2 had dipolma on file, but not their transcript. S-3 has proof of enrollment in course for the Winter 2024 quarter system. This poses a potential health and safety risk to children in care.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance. All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance...This requirement is not met as evidenced by: Based on record review, S-1 and S-2's has cleared criminal record and child abuse index. S-1 and S-2's fingerprints are associated to Licensee's other facility, but not to this facility. This poses a potential health and safety risk to children in care.
