Additional equipment shall be provided in facilities accommodating physically handicapped and/or nonambulatory residents, based on the residents' needs.This requirement is not met as evidence by: Based on interviews, record review, the Administrator/licensee did not ensure hot water or hot water accommodations were provided to residents, which poses a potential Health, Safe, or Personal Rights risk to persons in care

Theft and Loss 87218.... (a) The licensee shall ensure an adequate theft and loss program as specified in Health and Safety Code Section 1569.153.... (1) The initial personal property inventory shall be completed by the licensee, and the resident, or the resident’s representative.... (2) A licensee who fails to make reasonable efforts to safeguard resident property, shall reimburse a resident for or replace stolen or lost resident property at its current value. The licensee shall be presumed to have made reasonable efforts to safeguard resident property if there is clear and convincing evidence of efforts to meet each requirement specified in Section 1569.153.This requirement is not met as evidence by: Based on interviews and record review, facility did not follow theft & loss regulation for Resident#1 leading to R#1 loss and mismanagement of R#1 personal belongings, which poses a potential health, safety, or Personal Rights risk to persons in care.

Personnel Requirements – General 87411 (a) Facility personnel shall at all times be sufficient in numbers, and competent to provide the services necessary to meet resident needs. In facilities licensed for sixteen or more, sufficient support staff shall be employed to ensure provision of personal assistance and care as required in Section 87608, Postural Supports. Additional staff shall be employed as necessary to perform office work, cooking, house cleaning, laundering, and maintenance of buildings, equipment and grounds. The licensing agency may require any facility to provide additional staff whenever it determines through documentation that the needs of the particular residents, the extent of services provided, or the physical arrangements of the facility require such additional staff for the provision of adequate services.This requirement is not met as evidence by: Based on interviews and record review, facility staff did not follow proper requirements when Resident #1 sustained falls, which poses an immediate Health, Safety, or Personal Rights risk to persons in care.

This requirement was not met as evidenced by: Based on observation, interview and record review, the Licensee did not comply with the section cited above by not maintaining the facility clean and sanitary and not having housekeeping staff clean residents bedrooms daily which pose potential health, safety and personal rights risks to residents in care.

87705 Care of Persons with Dementia (5) Each resident with dementia shall have an annual medical assessment as specified in Section 87458, Medical Assessment, and a reappraisal done at least annually, both of which shall include a reassessment of...This requirement is not met as evidenced by: Based on interviews & records review, the Licensee did not comply with the section cited above by failing to complete the required annual medical assessment, reappraisal and reassessment done for R1's dementia care needs which pose potential health, safety and personal rights risks to resident in care.

This requirement was not met as evidenced by: Based on observation, interview and record review, the Licensee did not comply with the section cited above by not aggressively addressing the roaches’ issue at the facility which poses immediate health, safety and personal rights risks to resident in care.

87355 Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working... (1) Obtain a California clearance... This requirement is not met as evidenced by: Based on observation, interview and records review, the Licensee did not comply with the section cited above by allowing S7 and S8 to work at the facility without criminal backround which pose immediate health, safety and personal rights risks to residents in care.
