This report has been amended from the original report dated 02/26/26.101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to:...This requirement is not met as evidenced by: Based on witness statements and documentation reviewed, it was determined that a staff yelled at day care child after believing the child was attempting to run out the door. It was further confirmed that the staff member's tone was inappropriate and that yelling at close proximity to the child’s face was unnecessary which poses an immediate health, safety, or personal rights risk to persons in care.

101161(a) Limitations on capacity: A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by LPA observation of 4 infants combined with 6 preschool children and interviews that confirmed the combination of the children which posses an immediate health & safety risk to the children in care.

101229(a)(1) Responsibility for providing care and supervision: The licensee shall provide care and supervision as necessary to meet the children's needs. (1)No child(ren) shall be left without the supervision of a teacher at any time. This requirement was not met as evidenced by: an incident report and the interview with the director that disclosed a child was inadvertently left outside with no supervision which is an immediate health and safety risk to the children in care.
