ARTICLE 2. Administration of Child Day Care Licensing

1596.8595 (c)(1) A licensed child day care facility shall provide to the parents... copies of any licensing report that documents any Type A citation...as set forth in paragraph (1) of subdivision (a) of Section 1596.893b.This requirement was not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above by not providing reports documenting Type A citations to multiple parents of children in care, and only incomplete reports to those who received the reports. This poses a potential health, safety, or personal rights risk to persons in care.

1596.8595(a)(1) ) Each licensed child day care facility shall post a copy of any licensing report...that documents either a facility visit....that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt...and shall remain posted for 30 consecutive days. This requirement was not met as evidenced by: Based on observation, the licensee did not comply with the section cited above due to not posting licensing reports documenting Type A citations issued on 2/13/206 and 2/26/2026. This poses a potential health, safety, or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212 (d) Upon the occurrence…of any of the events specified in (d)(1) below, a report shall be made to the Department...(B) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.This requirement was not met as evidenced by: Based on interview, the licensee did not comply with the section cited above due to not reporting to licensing a parent notice that they had taken their child to the doctor due to an unusual incident occuring on the facility site. This poses a potential health, safety, or personal rights risk to persons in care.

101299(a) The licensee shall provide care and supervision as necessary to meet the children's needs.This requirement was not met as evidenced by: Based on interview, the licensee did not comply with the section cited above due to staff not providing supervision adequate to notice that nail polish was being used by children in care, leading to a child sustaining nail polish on their scalp. This poses an immediate health, safety, or personal rights risk to persons in care.

TRANSPORTATION

(c) Motor vehicles used to transport children shall be maintained in a safe operating condition.This requirement was not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above due to transporting children in a vehicle that did not have valid registration or legally required liability insurance that would cover injuries to passengers in the car. This poses an immediate health, safety, or personal rights risk to persons in care.

Criminal Record Clearance Requirements - Initial Clearance

Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification...prior to employment, residence, or initial presence in the facility.This requirement was not met as evidenced by: Based on interview and record review, LPA determined that an adult driver (A1) transporting children for the facility did not have a valid criminal background clearance to work in a child care center. This poses an immediate health, safety, or personal rights risk to persons in care.

TRANSPORTATION

Based on interview and record review, the licensee did not comply with the section cited above by not being able to access staff licensing records during LPA's visit. This poses a potential health, safety or personal rights risk to persons in care.

TEACHER AIDE QUALIFICATIONS AND DUTIES

101216.2(e) An aide shall work only under the direct supervision of a teacher.This requirement was not met as evidenced by: Based on observation, interview, and record review, the licensee did not comply with the section cited above due to an aide supervising 16 children alone without the presence of a teacher. This poses an immediate health, safety, or personal rights risk to persons in care.
