Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement was not being met as evidenced by: Based on interviews conducted, and staff admission, C1 was placed inside a restroom with the door closed while having a behavioral episode. This is a potential personal rights violation to children in care.

REPORTING REQUIREMENTS

Reporting Requirements: (d) Upon the.. child care.. in (d)(1) below, a report shall be.. fax within the Department's.. In addition, a written.. specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events..:(C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not being met as evidenced by: Based on interview and record review, the facility did not submit a UIR regarding the incident that occurred on 12/16/2026 involving C1 and C2 where C1's nose bled as a result of being slapped by C2. This is a potential health and safety risk to children in care.

Admission Agreements:(d) Modifications to the original admission agreement shall be made whenever circumstances covered in the agreement change, and shall be dated and signed by the persons specified in (c) above.This requirement was not being met as evidenced by: Based on staff interview, and confidential interview, C1's parent was not given proper notice for the facility to reduce C1's hours. This is a potential personal rights risk to children in care.

Reporting Requirements: (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event.(1) Events reported shall include the following:(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not being met as evidencee by: Based on the mentioned complaint investigation concluding that C1 had bitten several children in care, the incidents should have been reported to CCL. This is a potential health and safety and/or personal rights risk to children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a) Responsibility for Providing Care and Supervision; The licensee shall provide care and supervision as necessary to meet the children's needs. This was not met as evidenced by… Based on record review and interview with three out of three staff, child #1 was not picked up in a timely manner from the bus stop, resulting in the parent of C1 to retrieve the child from the school district on at least two or more occasions. This poses a potential health, safety and/or personal rights risk to children in care.
