Maintain facility in clean, safe, sanitary condition

87303 Maintenance and Operation(a) The facility shall be clean, safe, sanitary and in good repair at all times. Maintenance shall include provision of maintenance services and procedures for the safety and well-being of residents, employees and visitors.This requirement is not being met as evidenced by: Equipment in the kitchen that is not working or not properly working were confirmed by multiple individuals and photos were taken. Further, a request was made to approve expenses that will be used to purchase new equipment or repair the existing equipment.

Kitchen sanitation against contamination sources

87555 General Food Service Requirements(b) The following food service requirements shall apply:(27) All kitchen areas shall be kept clean and free of litter, rodents, vermin and insects.This requirement was not met as evidenced by: During the visit, LPA Haley observed bugs on the ground in an area behind the kitchen, a bug crawling across the commercial dishwasher, and flies flying over some fruit and utensils in one of the dining rooms. Photos were taken and a video was captured.

Care and supervision as defined by statute and rules

(f) Basic services shall at a minimum include:(1) Care and supervision as defined in Section 87101(c)(3) and Health and Safety Code section 1569.2(c). This requirement was not met as evidence by Resident 1 was able to elope from the facility Which poses an immediate safety and health risk to persons in care.

The licensee may, upon obtaining prior written approval from the licensing agency evict the resident upon three (3) days written notice to quit. The licensing agency may grant approval for the eviction upon a finding of good cause. Good cause exists if the resident is engaging in behavior which is a threat to the mental and/or physical health or safety of himself or to others in the facility. This requirement is not met as evidenced by facility did not comply with proper eviction procedures which poses an immediate health, safety or personal rights risk to persons in care.

A license shall be issued for a specific capacity which shall be the maximum number of residents which can be provided care at any given time. The capacity shall be exclusive of any members of the licensee's own family who reside at the facility... This requirement is not being met as evidenced by; Through a record review of the fire clearance and facility license and through interviews it has been determined that the facility has 258 residents and the approved fire clearance capacity and facility license is for 139 residents, this poses an immediate health and safety risks to residents.

This requirement is not being met as evidenced by: Based on interviews and record review, Licensee failed to ensure R1 was provided care and supervision. R1 eloped out of the facility and was discovered outside of the facility down the street. This poses an immediate health and safety risk to residents in care.
