RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by Director stating a child was waiting in the front hallway as a parent was gathering his children for pick up noticed child was not part of his group and had child wait in front and not exit the door with his . This poses an potential health and safety risk to children in care.

REPORTING REQUIREMENTS

101212 Reporting Requirements (d) Upon the occurrence, during the operation of the child care center... a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours... This Requirement is not met as evidenced by: Based on interviews and record review, The Facility did not notify Licensing of incident within 24 hours of incident, which poses a potential Health or Safety, or personal rights risk to persons in care.

101212 Reporting Requirements (f) The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative.This Requirement is not met as evidenced by: Based on interview and record review, The Facility did not notify parent that an incident occurred which poses an potential Health or Safety, or personal rights risk to persons in care.

Prohibited positions or employment; grounds; notice; removal; appeal; petition for reinstatement, (a)(2) Engaged in conduct that is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility... This Requirement is not met as evidenced by: Based on IB investiagtion, interviews and review of records IB reveled that the violent altercation between Staff#1 and Staff# 2 posed a risk to children and other staff; therefore, the allegation of conduct inimical is substantiated.

Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance...prior to employment, residence, or initial presence in the facility.This requirement is not met as evidenced by: Based on Licensee's disclosures of an uncleared adult volunteering/working in the facility since May of 2025, a civil penalty of $500.00 is being assessed and a Type A deficiency is being cited due to licensee not complying in having Adult #1 obtain a criminal record clearance which poses an immediate health, safety or personal rights risk to persons in care.

NAPPING EQUPMENTNapping equipment shall be arranged so that each child has access to a walkway without having to walk on or over the cots or mats of other children.This requirement is not met as evidenced by: During the tour, LPA and LPM observed that the cots in Pre-K(A) were positioned so that there was not a walkway between the cots without having to walk on or over the cots of other children. This poses a potential risk to the health, safety or personal rights of the children in care.

ACTIVITIES/NAPPING

ACTIVITIESA teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. This requirement is not met as evidenced by: during the tour, there was one staff with 19 children in Pre-K (A) and not all of the children were napping. This poses a potential risk to the health, safety or personal rights of the children in care.
