RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

The licensee shall provide care and supervision....(1) No child(ren) shall be left without the supervision of a teacher at any time,...This requirement was not met as evidenced by Based on the facility's admission of a unusual incident report (UIR) on 04/01/26 and director statement, a child was unsupervised for an unknown amount of time in the school age classroom.

The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations: (1) Any violation that the department determines resulted in the injury or illness of a child. This requirement is not met as evidenced by: Based on the facility's UIR and interviews conducted by CD and two Staff, a child was This poses an immediate health and safety risk to children in care. A civil penalty of $500 is being issued.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a)(1) Responsibility for Providing Care and Supervision: (a) The licensee shall provide care and supervision....(1) No child(ren) shall be left without the supervision of a teacher at any time,...This requirement was not met as evidenced by Based on the facility's admission of a unusual incident report (UIR) Notification on 01/07/26, a child was unsupervised for approx. 2 minutes, but less than 5 minutes located in the fully fenced large playground.

CHILD'S MEDICAL ASSESSMENTS

Child's Medical Assessments: Prior to, or within 30 calendar days following the enrollment of a child, the licensee shall obtain a written medical assessment of the child. This requirement is not met as evidenced by: Based on record reviews, the licensee did not comply with the section cited in 1 out of 5 children, which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 1. General Provisions and Definitions

Employees or volunteers at day care center; immunization requirements; records; Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 & December 1 of each year. This requirement is not met as evidenced by: Based on record reviews, the licensee did not comply with the section cited above in 3 out of 9, which poses a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

Availability of information regarding detecting and reporting child abuse and neglect; training for mandated reporter who is licensed day care provider, administrator, or employee of a licensed child day care facility; proof of completion. On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training(MRT) and shall complete renewal every two years following the date on which he or she completed the initial MRT.

Outdoor Activity Space fo Children - In combination programs, outdoor activity space provided for school-age child care center children shall be physically separated from space provided for other child care center children. This requirement is not met as evidenced by: Based on LPA's observation, the licensee did not comply with the section cited above, which poses a potential health, safety or personal rights risk to persons in care.

TEACHER-CHILD RATIO

Teacher-Child Ratio:There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c). This requirement is not met as evidenced by: LPA's observing 1 teacher & 6 aides supervising 49 children on 7/2/2025 Based on LPA's observation on 7/2/2025 of 1 teacher & 6 aides supervising 49 children and on 8/6/2025, LPA observing assistant director and 2 aides supervising 23 children in the larger outdoor play area and 1 teacher and 2 aides supervising 19 children in the 2's and 3's outdoor play area.

PERSONNEL REQUIREMENTS

Personnel Requirements: All personnel, including the licensee, administrator & volunteers, shall be in good health & shall be physically & mentally capable of performing assigned tasks. Each person specified shall have a health-screening report signed by the person performing the screening. This requirement is not met as evidenced by: Based on record reviews, the licensee did not comply with the section cited above in 1 out of 9 staff, which poses a potential health, safety or personal rights risk to persons in care.

The child care center shall operate in accordance with the terms specified in the plan of operation.This requirement is not met as evidenced by: Based on statements provided by staff, child interviews, Vacaville PD report, and a review of page 9 in Employee Handbook which confirmed the facility did not comply with its own plan of operation. This poses/posed a potential health, safety, and/or personal rights risk to the children in care.

IMMUNIZATIONS

Based on five children's (C1-C5) records reviewed which revealed C1-C3 & C5's Immunization were transcribed on incorrect or missing CDPH 286. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on five children's (C1-C5) records reviewed which revealed C3 & C5 were missing Physician Report (LIC 701). The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on five children's (C1-C5) records reviewed which revealed C1-C3's Enrollment Agreements were not signed by the parents. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 1. General Provisions and Definitions

Based on five staff (S1-S5) records reviewed which revealed S1-S5's required Immunization Records (IR) were missing or incomplete. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on five staff (S1-S5) records reviewed which revealed S1 & S3-S4 were missing Employee Rights (LIC 9052). The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

TEACHER QUALIFICATIONS AND DUTIES

To be a fully qualified teacher, a teacher shall have one of the following: Twelve post-secondary semester or equivalent quarter units in early childhood education or child development completed, with passing grades, at an accredited or approved college or university; and at least six months of work experience in a licensed child care center or comparable group child care program.This requirement was not met as evidenced by: Based on multiple statements corroborating Aides without ECE units were left alone to supervise the children, and this posed an potential health, safety and/or personal rights risk to the children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement was not met as evidenced by: Based on the Director's statement confirmed there was a lack of supervision which resulted in a child (C1) eloping from the facility. This poses/posed an immediate health, safety and/or personal rights risk to the children in care.

TEACHER-CHILD RATIO

There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below.This requirement was not met as evidenced by: Based on a substantiated complaint allegation which corroborated a the facility operated out of ratio on multiple occasions. This poses/posed an immediate health, safety and/or personal rights risk to the children in care.

BUILDINGS AND GROUNDS

Based on LPA's observations of a large section of the wooden fence and gate near the preschool playground which appeared to be in dis-repair. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL REQUIREMENTS

Based on six staff (S1-S4, AD & CD) records reviewed at 1:52pm which revealed S4 was missing Health Screening (LIC 503). The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on six staff (S1-S4, AD & CD) records reviewed at 1:52pm which revealed S1-S2, S4, AD & CD were missing proof of immunity against Measles. The licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 2. Administration of Child Day Care Licensing

On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on five staff (S1-S5) records reviewed at 1:54pm which revealed S2-S4's records were missing AB 1207 Mandated Reporter Training certificates. This posed a potential health, safety and/or personal rights risk to children in care.

CRIMINAL RECORD CLEARANCE

Obtain a California clearance or a criminal record exemption as required by the Department.This requirement is not as evidenced by: Based on Department records and interviews conducted with CD, S3, A2 & A3 which confirmed an adult without criminal record clearance worked in DP classroom for more than five days in the month of July 2023, and as such, an immediate CP of $500 was assessed. This posed an immediately health, safety and/or personal rights risk to the children in care.

PERSONNEL REQUIREMENTS

Except as specified in (3) below, good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement was not met as evidenced by: Based on five staff (S1-S5) records reviewed at 1:54pm which revealed S2-S3 & S5's records did not contain evidence of negative TB clearance. This poses/posed a potential health, safety and/or personal rights risk to the children in care.

This poses a potential health, safety and/or personal rights risk to the children in care.

101216.1(B)(1)Teacher Qualifications and Duties. Prior to employment, a teacher shall meet the requirements...(1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement. Based on facility record review, Staff did not have the required units and no verification of staff ECE units were present at the faculity. This poses a potential Health and Safety risk to children in care.

TEACHER-CHILD RATIO

101216.3(a) Teacher-Child Ratio. There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. Based on observation and interviews, on multiple occasions, 1 Staff was supervising over 12 daycare children at one time. This poses a potential Health and Safety risk to children in care.

Teacher-Child Ratio - There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by: based on LPA observations, children were being supervised by a staff member who was not qualified as a teacher.

Teacher qualifications-Health and Safety Code Section 1597.055 states in pertinent part:Notwithstanding any other educational requirements, a person may be hired as a teacher in a day care center if he or she satisfies all of the following conditions: Possesses a regional occupation program certificate of training in child care occupations issued by a regional occupational program which is accredited by the Western Association of School and Colleges. This requirement was not met as evidenced by: based on staff records staff were hired as teachers without all qualifications needed.
